Terms of Service

These Terms of Service ("Terms") govern your access to and use of Warmpen (warmpen.com) and related services (the "Service"), operated by MDL Network LLC ("we", "us", or "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or 16 in the EU/UK) to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
You may not use the Service if you are barred from doing so under applicable law or have been previously banned from the Service.
2. Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
You must provide accurate and complete information when creating an account. We may suspend or terminate accounts that contain false information, are used for prohibited purposes, or violate these Terms.
You may not share your account credentials, sublicense your access, or allow others to use your account.
3. The Service
3.1 Description
Warmpen is an AI-powered text humanization tool that rewrites AI-generated text to sound more natural and human-like. Results are produced using third-party AI providers and are best-effort in nature.
3.2 No Guarantee of Detection Bypass
We do not guarantee that humanized text will bypass any specific AI detection tool, plagiarism checker, or academic integrity system. Detection tools change frequently, and results vary based on input text, settings, and the detector being used.
You acknowledge that:
- Output is provided "as is" without guarantee of detector bypass results
- Detection scores shown in the Service are estimates based on text patterns and may not reflect any specific third-party detector
- You are solely responsible for verifying output meets your needs
3.3 Service Modifications
We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.
4. Subscription Plans and Payment
4.1 Plans
The Service offers a free tier and paid subscription plans (Starter, Pro, Unlimited) with varying word quotas and features. Current pricing and features are listed on our pricing page.
4.2 Billing
- Paid subscriptions are billed in advance on a recurring basis (monthly or yearly)
- Payment is processed by Stripe; we do not store your full payment details
- Subscriptions automatically renew at the end of each billing period unless canceled before renewal
- We may change pricing with at least 30 days' notice; changes apply at the start of your next billing period
- All fees are in USD unless otherwise specified
- You are responsible for any applicable taxes
4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that period ends.
5. Refund Policy
5.1 General Policy
Warmpen subscription fees are generally non-refundable. By purchasing a subscription, you acknowledge that you are paying for access to the Service, and that fees paid in advance will not be refunded except as described below or as required by applicable law.
5.2 When We Offer Refunds
We may issue full or partial refunds in the following situations:
- Technical failure: If a technical issue on our end prevents you from using paid features for more than 48 hours of continuous downtime, and our support team cannot resolve it, we may issue a pro-rated refund for the affected period.
- Billing errors: If you were charged incorrectly (duplicate charges, wrong amount, charged after cancellation), we will refund the incorrect charge promptly upon verification.
- Unauthorized charges: If your account was used to make purchases without your authorization, contact us immediately.
- 7-day money-back guarantee for first subscription: If you cancel your first paid subscription within 7 days of the initial purchase and have used fewer than 1,000 humanized words, you may request a full refund. Applies only to your first subscription, not renewals.
- Required by law: We will issue refunds where required by applicable consumer protection law.
5.3 When We Do Not Offer Refunds
Refunds are not offered for:
- Partial billing periods after the 7-day window
- Subscription renewals (cancellation prevents future renewals but does not refund the current period)
- Services that have been used substantially (more than 1,000 humanized words within the billing period)
- Issues caused by your own actions (account misuse, violations of these Terms)
- Dissatisfaction with output quality
- Failure of humanized text to bypass any specific AI detection tool
- Inability to use the Service due to factors outside our control
- Account terminations due to violations of our Terms or Acceptable Use Policy
5.4 How to Request a Refund
Email support@warmpen.com with your account email, the subscription plan, billing period, and reason for the request. We respond within 5 business days. Approved refunds process within 5-10 business days, returned to your original payment method via Stripe.
5.5 Chargebacks
Filing a chargeback with your bank is a last resort. If you have a billing concern, contact us first. Filing a chargeback without first contacting us may result in immediate account suspension and a permanent ban from the Service.
6. Acceptable Use
You agree not to use the Service to:
6.1 Illegal Content
- Generate or process content that violates any applicable law
- Process content that infringes intellectual property rights you do not own
- Create defamatory, libelous, or knowingly false content about identifiable individuals
- Process content involving the exploitation of minors in any context
6.2 Deception in Regulated Contexts
- Submit text for use in legally binding contexts where authorship attribution is required (sworn statements, regulatory filings)
- Generate fake reviews, testimonials, or endorsements
- Impersonate real people in ways that cause harm
- Create misleading content for political manipulation or coordinated inauthentic behavior
6.3 Academic Fraud Where Prohibited
- Submit Warmpen-edited text as your own original work in academic contexts where AI assistance is explicitly prohibited
- Use the Service to circumvent academic integrity policies
- This Service is a tool — you are responsible for following your institution's policies on AI tool use
6.4 Harmful or Hateful Content
- Generate content promoting violence, self-harm, or terrorism
- Produce hate speech targeting individuals or groups based on protected characteristics
- Create harassment, threats, or content intended to intimidate
6.5 Sexual Content
- Generate sexually explicit content involving real people without consent
- Generate any sexual content involving minors
- Produce non-consensual intimate content
6.6 Service Abuse
- Bypass quotas, rate limits, or other technical protections
- Use multiple accounts to circumvent free-tier limits
- Share or sell account access
- Automate access via bots, scrapers, or scripts without explicit permission
- Resell humanization output as a competing service
- Reverse engineer the Service or extract our prompts/internal logic
- Submit deliberately malicious input (prompt injection, model attacks, etc.)
6.7 Security and Stability
- Attempt to gain unauthorized access to the Service or other users' accounts
- Submit malware, viruses, or other malicious code
- Use the Service in ways that could overwhelm infrastructure (DoS attempts)
We may suspend or terminate accounts that violate these terms without refund.
7. Your Content
7.1 Ownership
You retain all rights to text you submit to the Service. We do not claim ownership of your input or output.
7.2 License to Operate
You grant us a limited, non-exclusive, worldwide license to process your submitted text solely for the purpose of providing the Service. This license terminates when the humanization request completes.
7.3 Responsibility for Content
You are solely responsible for the content you submit and the use you make of the output. We are not responsible for any consequences of your use of humanized text, including but not limited to academic, professional, or legal consequences.
7.4 No Training Use
We do not use your submitted content to train AI models. Submitted text is sent to third-party AI providers which have their own data handling policies; we use providers that do not train on user input where possible.
8. Intellectual Property
8.1 Our IP
The Service, including its design, logos, code, and content (other than your submissions), is owned by MDL Network LLC and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our written permission.
8.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
9. Third-Party Services
The Service relies on third-party services (Stripe, Google, Supabase, Vercel, Upstash, etc.). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services' actions, availability, or policies.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Output will meet your requirements or pass any specific detector
- Defects will be corrected
- The Service is free from viruses or other harmful components
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER
- THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STATUTE, ETC.)
Some jurisdictions do not allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless MDL Network LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any law or third-party right, or content you submit to the Service.
13. Termination
You may terminate your account at any time by canceling your subscription and contacting us to delete your data.
We may suspend or terminate your account at any time if you violate these Terms, if required by law, if we discontinue the Service, or if we have reasonable grounds to suspect fraud or abuse.
Termination does not entitle you to a refund except as required by applicable law.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (Sections 5, 7, 8, 10, 11, 12, 14, 15) will survive.
14. Governing Law and Disputes
14.1 Governing Law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws principles.
14.2 Disputes
Any dispute arising from these Terms or the Service shall first be addressed by good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, in English, in a venue mutually agreed upon or determined by the arbitrator.
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
This section does not prevent either party from seeking injunctive relief in a court of competent jurisdiction for IP infringement or breach of confidentiality.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 14 days before they take effect (or immediately if required for legal compliance). Your continued use after changes take effect constitutes acceptance.
If you do not agree to revised Terms, you must stop using the Service before the changes take effect.
16. Miscellaneous
- Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
